This article begins by conceptualizing health, then makes a first approach to defensive medicine in Ecuador, a phenomenon that has been little analyzed. It seeks to establish the milestones that have marked defensive medicine in the country and its effects. A mixed methodology is used in which information from a third level of complexity facility is used with information from 2007 to 2017. It is concluded that it is important for medical practice to think more about the welfare of the patient and the entire system before possible legal claims.
